In order to be permitted to use our services, the User must click "I agree" after reading the entire agreement set forth below. Until you agree to the terms of this User Agreement, you are prohibited from further use of this site and/or web address. Do not proceed unless you agree to each and every term set forth below. By clicking "I agree," you hereby certify that you have read and understood all of the terms and conditions set forth below and agree to be bound by those terms.

Privacy Policy

It is our policy to protect your privacy to fullest extent possible as described in our Privacy Policy. However, transmission of your medical information and emergency contact information over the internet, by fax machine, verbally or through third party database companies is necessary and an essential element of our company's service to you. We provide a valuable service to you by transmitting to "First Responders", such as ambulance companies, fire or police departments, hospitals, emergency departments, physicians, nurses, EMS, schools, sport organizations, and others who agree to access our services for purposes of providing emergency care to you with information that you have provided to us regarding your health history, allergies, medication history and other information you deem important for a First Responder to know in the event of an emergency, including who to contact in the event of an emergency (this information is referred to as your "Emergency Health Profile"). By indicating "I agree" below, you hereby authorize us to receive your Emergency Health Profile information and use or disclose it as follows:

You will provide us with information regarding your health history, allergies, medications and other information you deem necessary for the use by First Responders who treat you in the case of an emergency, including the identities and contact information for those persons who you wish to be contacted in the event of an emergency ("Emergency Health Profile").
You hereby authorize us to maintain your Emergency Health Profile using the security procedures described in this User Agreement and in accordance with our Privacy Policy.
You hereby authorize us to release the Emergency Health Profile upon verbal or written request by a "First Responder" (defined above). We are entitled to rely on statements made by the First Responder that it needs the information for purposes of rendering emergency care to you, and we have no obligation to investigate or confirm the accuracy of representations made to us by First Responders.
You understand that we cannot control the use of your Emergency Health Profile once we have released it according to this User Agreement, and you understand that it may be subject to re-disclosure by the recipient.
You are permitted to revoke this authorization at any time provided that you submit your revocation to us in writing by mail or by contacting us on our web site. Upon receipt of a written notice of revocation from you, we will promptly delete your Emergency Health Profile from our database. You agree, however, that we may retain your name, address, e-mail address and phone number unless you specifically request in writing to deleted that information as well. Until we have a confirmed receipt of a written revocation from you, we may follow your prior authorizations to use and disclose your Emergency Health Profile as provided in this User Agreement.
You understand that First Responders may access your Emergency Health Profile through the Internet, by phone (cellular or otherwise), verbally or by fax transmission. We cannot guarantee that these modes of transmission are reliable or that the First Responders will receive your Emergency Health Profile on a timely bases, if at all.
Your right to receive emergency care from a First Responder is not affected by this User Agreement or its revocation.

Security

You agree that if you are issued a Username and Password by the Company, you shall use your best efforts to prevent access to this site through your Username and Password by anyone other than yourself, including but not limited to, keeping such information strictly confidential, notifying the Company immediately if you discover loss or access to such information by another party not under your control and supervision, and by using a Username and Password not easily guessed by a third party.

You agree that you shall not try to reverse engineer, reverse assemble, reverse compile, decompile, disassemble, translate or otherwise alter any executable code, contents or materials on or received via this site. You understand that such actions are likely to subject you to serious civil and criminal legal penalties and that the Company shall pursue such penalties to the full extent of the law to protect its rights and the rights of its other licensors.

International Users

Accessing this site, and services, products or contents available on this site, except as expressly allowed through instructions and truthful statements by the User in regard to use of this site, from places outside the U.S. or where their contents are illegal, is prohibited. Those who choose to access this site from other locations do so knowingly on their own initiative and voluntarily at their own risk and are responsible for compliance with local laws. None of the information on this site may be downloaded, exported or reexported into Libya, Iraq, North Korea, Cuba, the National Union for the Total Independence of Angola (UNITA), Iran, Syria, Sudan, Burma (Myanmar), Serbia, the Taliban, Sierra Leone, Liberia, designated Terrorists and international Narcotics Traffickers, Foreign Terrorist Organizations, and/or designated foreign persons who have engaged in activities related to the proliferation of weapons of mass destruction or any other country with restrictions imposed by the U.S. Government. USER'S LICENSE GRANT TO SITE

INDEMNIFICATION

Company may suspend or terminate this Agreement or User's use immediately upon receipt of any notice which alleges that User has used this site for any purpose that violates any local, state, federal or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault others, that may violate hacking or other criminal regulations, etc. of its agents, officers, directors, contractors or employees. In such event, Company may disclose the User's identity and contact information, if requested by a government or law enforcement body or as a result of a subpoena or other legal action, and Company shall not be liable for damages or results thereof and User agrees not to bring any action or claim against Company for such disclosure.

CHOICE OF LAW AND FORUM

This site (excluding third party linked sites) is controlled by the Company from its offices within the State of California, U.S. of America. It can be access from all 50 states as well as from other countries around the world to the extent permitted by site. As each of these places has laws that may differ from California, by accessing this site, both you and the Company agree that the statues and laws of the State of California shall apply to any actions or claims arising out of or in relation to this Agreement or your use of this site, without regard to conflicts of laws principles thereof. You and the Company also agree and hereby submit to the filing of any claim only in the exclusive personal jurisdiction and venue of California and any legal proceedings shall be conducted in English. MISCELLANEOUS

This Agreement incorporates by reference the Site Submission Rules if this site allows posting and posts such Rules. This Agreement constitutes the entire agreement between the parties related to the subject matter thereof, supersedes any prior or contemporaneous (oral, written or electronic) agreement between the parties and shall not be changed except by written agreement signed by a member or authorized agent of the Company.
